Our Purchase Agreement/ Health Guarantee- this is the contract we use for a puppy being sold with limited AKC registration (pet) .

Purchase Agreement
This is a contract for the sale of a pet quality AKC Chihuahua. This documents concerns a live animal and is executed with prejudice in the favor of that animal's well-being by the undersigned. This agreement is between David and Tandy Brown (breeder/seller) and the above-named buyer for one puppy:
Breed, Sex, Birth Date, Name, Color/Coat and Parents of Puppy
Thank you for deciding to purchase one of our puppies. We want to make this a stress-free enjoyable experience for you. Please feel free to email or call us with any questions or concerns that you might have along the way. We will keep you up to date with information about your puppy as it grows until it is time for your puppy to go to its new home.
This contract is written for the protection of both the breeder and the buyer - However, it is primarily written to protect the health and general well-being of the puppy.
Purchase Agreement
1. Please read the purchase agreement/health guarantee completely before putting a deposit on a puppy. By putting a deposit on a puppy, you are agreeing to the terms and conditions within this contract. The purchase price of the above puppy is $______________. Buyer paid a deposit of $ 300.00 on _________ via _____________ to hold the above puppy. This deposit is non-refundable unless the puppy is not available due sickness, death or any other circumstance owing to the fault of the breeder. In that case, the buyer will have their choice of a full refund or of transferring that deposit toward another puppy. The deposit is for this puppy and this puppy only and cannot be transferred to another puppy unless this puppy is not available owing to the fault of the breeder.
2. The balance of $__________ will be due upon the release of the puppy to Buyer. This balance is due on the mutually agreed upon pickup date on or after ________________ and will be paid in cash unless other arrangements are made to use another payment method in advance of pickup.
-Shipping
-via pet nanny: If shipping via pet nanny, the balance of $_______ is due 3 days prior to shipping date. All other shipping charges will be paid directly to the Flight Pet Nanny service.
-via cargo, the balance of $____________ + shipping charges of $_____ is due 5 days prior to shipping date.
The balance plus shipping can be paid via the following options: Zelle, Cash App, Venmo or Square. If the final payment is made with either Venmo (tagged as a purchase) or Square a 3% convenience fee will be added to the total. The buyer also acknowledges and agrees that any refund of shipping costs will be given at the discretion of the breeder.
Puppy needs to be picked up before 10 weeks of age unless otherwise agreed upon by Buyer and Breeder. Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the puppy if: (a) Buyer fails to complete the purchase of the puppy for any reason, (b) Buyer fails to arrange a pickup/shipping date at least 14 days prior to ________________ or (c) Buyer fails to pay the balance of the Purchase Price by the mutually agreed pickup date. In this event, the Breeder shall be free to sell the puppy to another party.
Health Guarantee
1. The puppy is guaranteed to be in good health at the time of sale.
2. The puppy will be up to date on shots and worming at the time of pickup of the puppy. It is important that you continue the vaccinations and worming. Please do not expose your puppy to other dogs that are not vaccinated until he/she has completed the entire vaccination schedule - around 16-20 weeks old.
3. The puppy will have been vet checked at 6-7 weeks old and deemed in good health.
4. The buyer, at their own expense, needs to have the puppy examined by a Licensed Veterinarian for genetic defects, within three business days of receiving the puppy; documentation of this examination must be provided to the breeder for the Health Guarantee to be honored. Failure to do will result in the forfeiture of the rights of the health guarantee.
5. If within three business days, a Licensed Veterinarian finds the puppy to be unhealthy or unfit for sale, the puppy may be returned to breeder for a full refund of purchase price (not including shipping cost) - provided the puppy has not been injured or neglected. The veterinarian must provide a written statement deeming the puppy “unhealthy for purchase,” along with details as to why the puppy is unhealthy. Buyer will be responsible for any costs in returning the puppy to the breeder. There is no coverage for Coccidia, Giardia, parasites, hypoglycemia, hernias, cryptorchidism, open fontanelle, malocclusion or luxating patellas.
6. All veterinarian bills and shipping expenses are the responsibility of the buyer.
7. This guarantee does not cover any health issues caused by neglect or injury from the buyer. It is the responsibility of the buyer to care for the puppy properly and keep it free from harm. Please remember that your puppy must be treated with great care and protected from danger.
8. This guarantee does not include minor illnesses and health issues such as colds, allergies, internal or external parasites, hernias, malocclusion, cryptorchidism, or cherry eye. However, the breeder will disclose any known illnesses or health issues prior to the sale.
9. The breeder assumes no responsibility for any medical expenses incurred after the sale.
10. The breeder assumes no responsibility for training difficulties or behavior problems.
11. The breeder does not guarantee size, color, or coat type. We can give the buyer an educated guess as to adult weight and future coat color or type.
12. The puppy is strictly sold as a TOP QUALITY PET and will come with limited AKC registration.
13. The breeder is not responsible for puppies which develop Hypoglycemia after the puppy is in the new owner’s possession. The buyer will receive information on what to do if this occurs.
14. The breeder gives a guarantee up to one year of age against any genetic defects of the puppy. There is no warranty for luxating patellas or bite issues. If within this time period, a licensed veterinarian determines that the puppy has a genetic defect that will adversely affect the puppy’s health or that the puppy died as the result of a genetic defect, we will provide the buyer with the below options if this should occur. This needs to be the opinion of two unassociated Veterinarians, one being our Veterinarian, if at all possible, that this genetic defect will a) seriously impact the quality of life or b) require continuous medical treatment throughout the course of the puppy's life or c) in the case of the death of the puppy, was the direct cause of the puppy’s death. Once the breeder is provided written confirmation (veterinarian certification) from both veterinarians as to the nature of the defect and at least one necropsy in the case of the death of the puppy (that we will discuss with our veterinarian for the second opinion):
1. The buyer can choose to keep the puppy and accept partial refund. With receipt of proof of spay/neuter, we will refund 50% of purchase price or the buyer can choose to give up ownership of the puppy to us and we will replace the puppy within 12 months. The buyer accepts this condition. Buyer will be responsible for any costs in returning the puppy to the breeder.
2. If the two veterinarians agree the genetic defect requires euthanasia or was the direct cause of the puppy’s death, we will replace the puppy within 12 months. The buyer accepts this condition.
15. Within two business days of the veterinarian’s certification of your dog’s illness, defect, or death, you must notify the breeder of the name, address, and telephone number of the examining veterinarian. Failure to notify the breeder within two business days will result in forfeiture of the rights of the health guarantee. A copy of the veterinarian certification shall be presented to the breeder no later than five days after you receive it-failure to do so will also result in forfeiture of the rights of the health guarantee. Any refund shall be made no later than 14 days after the breeder receives the copy of the veterinarian certification. If a genetic defect is discovered by a veterinarian in the puppy, the veterinarian certification must include: a letter from the veterinarian on business letterhead, stating the nature of the genetic defect and/or in the case of death, the necropsy with the cause of death. The letter will have to state that the health condition is a genetic defect or the death was a direct result of the genetic defect in the case of a necropsy. A physical description of the puppy and the puppy’s microchip # must be included as part of the letter for identification purposes. The veterinarian phone number must be included on the letter as the Breeder must be given permission to discuss the health condition or necropsy directly with the veterinarian. Failure to do so will result in the forfeiture of the rights of this health guarantee.
If there is a dispute with this contract, it will have to be brought to Muskogee County, Oklahoma.

The buyer understands and agrees that any puppy purchased with full AKC registration should have Chimney Mtn’s as a prefix to their AKC registered name. The buyer also understands and agrees that this puppy has been evaluated by the breeder as a show/breeding prospect but NO guarantee is being made as far as future breeding/showing ability. The puppy is being sold with full AKC registration.
2. The purchase price of the above puppy is $ ____________. Buyer paid a deposit of $ ________ on _____ via ______to hold the above puppy. This deposit is non-refundable, unless the puppy is not available due to sickness, death or any other circumstance owning to the fault of the breeder, or if the puppy has a disqualification according the AKC breed standard (except weight because adult weight is just an estimate in any dog under 6 months old). In that case, the buyer will have their choice of a full refund or of transferring that deposit toward another puppy. The deposit is for this puppy and this puppy only and cannot be transferred to another puppy unless this puppy is not available owing to the fault of the breeder.
3. -Pickup: The balance of $__________ will be due upon the release of the puppy to Buyer. This balance is due on the mutually agreed upon pickup date on or after ________________ and will be paid in cash unless other arrangements are made to use another payment method in advance of pickup.
